Childcare Centre Construction — ACECQA Requirements in NSW

Space requirements, NQF Quality Area 3, accessibility standards, and what a builder must know before starting a childcare centre in New South Wales.

Direct answer: NSW childcare centres must meet National Quality Framework minimums of 3.25sqm indoor space and 7sqm outdoor space per approved child. A licensed builder must also meet NCC building classification requirements, AS 1428.1 accessibility standards, natural lighting and ventilation requirements, and council development consent conditions. These requirements are non-negotiable — ACECQA will not grant service approval to a centre that doesn’t meet them.

These are minimums. They apply to usable space — bathrooms, kitchen, sleep rooms, storage, corridors, staff areas, and nappy change rooms do not count toward the indoor space minimum. A builder who doesn’t understand this will design a centre that meets the headline sqm figure but fails the usable space assessment.

NQS Quality Area 3 — Physical Environment

Quality Area 3 of the National Quality Standard (NQS) sets requirements for the built environment of childcare centres. Relevant construction requirements include:

  • Natural light and ventilation: All indoor spaces used by children must have access to natural light and adequate ventilation. Skylights count if they provide adequate diffuse light; borrowed light through internal windows does not.
  • Safe design: Surfaces, fixtures, and fittings must be designed to prevent injury. This covers floor finishes, furniture fixing points, door thresholds, and window sill heights.
  • Outdoor spaces: Outdoor areas must be designed to allow children to move freely and support physical activity. Hard surfaces, soft-fall areas, and shade structures must all be included in the design documentation.
  • Sleep areas: Defined sleep areas for children under 2 must meet floor area, ventilation, and supervision sight-line requirements. They cannot be multi-purpose rooms used for other activities during sleep periods.

Building Code of Australia Classification

Under the National Construction Code (NCC), childcare centres are classified as Class 9b buildings (assembly buildings). This classification imposes specific requirements for fire safety, emergency egress, structural loading, and energy efficiency that differ from Class 1 (residential) construction. A builder experienced only in residential work who takes on a childcare centre without understanding Class 9b requirements creates compliance and safety risk.

Accessibility — AS 1428.1

AS 1428.1 (Design for Access and Mobility) applies to all areas of a childcare centre accessible to children, parents, and staff, including people with disability. Required elements include: accessible entry at grade or via ramp (maximum 1:14 gradient), accessible parking bay within 50m, accessible bathrooms (minimum 1), tactile ground surface indicators at key decision points, and door hardware operable with one hand. These requirements are built into the DA documentation and verified by the building certifier at practical completion.

What This Means for the Builder You Engage

ACECQA does not approve buildings — it assesses whether your service can operate in the building you’ve constructed. But building to the NQF minimums is the foundation of that approval. A builder who understands the National Quality Framework, NCC Class 9b requirements, and AS 1428.1 will design and build a centre that passes. One who learns these requirements on your job will either cause delays or leave you with a building that needs rectification before service approval is granted.
